Subclass 187: Regional Sponsored Migration Scheme visa - Temporary Residence Transition stream

The 187 Regional Sponsored Migration Scheme visa- Temporary Residence Transition Stream allows skilled workers nominated by their employer in regional areas of the country to live and work in Australia permanently

With this visa, you can:

  • Live and study/work full time in Australia permanently
  • Apply for Medicare
  • Sponsor your immediate family to come to Australia.
  • Apply for Citizenship once eligible. 

Subclass 187 - Temporary Residence Transition stream Eligibility

To be eligible for a Subclass 187 - Temporary Residence Transition stream, you must: 

You must be under 45 when the Department invites you to apply for the visa.

You can still apply for the visa if you turn 45 after the Department invites you.

You must have one of the primary visas from the following:

  • a subclass 457 visa
  • a subclass 482 (TSS) visa
  • a bridging visa A, B or C

The bridging visa must be the one you were granted after your subclass 457 or TSS visa expired.

You must have the suitable license, registration or membership of a professional body to apply for this visa if your state or territory demands for it.

You must be nominated by the employer who had initially sponsored your subclass 457 or subclass 482 visa.

You should have worked for at least 3 or 4 years with the employer prior to applying for this visa.

If you held (or had applied for and were later granted) a subclass 457 visa before or on 18 April 2017, your employer must have sponsored you to work full-time for at least 2 of the 3 years prior to nominating you for this visa.

The nomination from your employer needs to be approved in 6 months prior to applying.

You must have the required skills and qualifications for the occupation you are nominated for.

At the time of invitation, you must have at least competent English.

You and family members aged 16 years and over who apply for the visa with you must meet the Department’s health and character requirements.

You must not have a visa cancelled or refused previously to be eligible to apply for this visa.

    Can I be exempt from the age requirement?

    You are exempt from this criteria if any of the following applies to you:

    • you are nominated as an academic (university lecturer or faculty head at Academic Level B, C, D or E) by a university in Australia
    • you are nominated as a scientist, researcher or technical specialist at ANZSCO skill level 1 or 2 by an Australian scientific government agency
    • you are a medical practitioner who has worked in your nominated occupation for at least three years as a 457 or 482 visa holder. For two of those years you were employed in regional Australia. 
    • as a subclass 457 or 482 visa holder, you have been working in the nominated occupation for the nominating employer for at least the last 3 years, and your earnings were at least as much as the Fair Work High Income Threshold for each year of that period

     

    If you held (or had applied for and were later granted) a subclass 457 visa on 18 April 2017, you can still apply for this visa if you are under 50 when you apply.

    Is there any COVID-19 concession for age requirement for Subclass 187 - TRT Stream?

    If you were stood down or required to work reduced hours due to COVID-19, your earnings and the high income threshold are assessed at a pro rata rate for the affected years.

    This concession applies for applications lodged on or after 24 November 2020 and in relation to periods of COVID-19 since 1 February 2020.

    Does the employer have an eligibility criteria to follow in order to nominate for this visa?

    Make sure that the employer who has nominated you must,

    • Own an active and legal business in Australia 
    •  Requires full-time employees 
    • Can pay industry standard wage rate 
    • Comply with workplace laws of Australia 
    • Provide you with employment for at least the next 2 years
    Do I need to be in Australia to apply for the visa?

    You can either be in Australia or overseas when you apply for a Subclass 187 Temporary Residence Transition Stream.

     

    Is there any special condition for the Subclass 187 visa?

    You must not marry or enter into a de facto relationship before entering Australia.

    Your visa might be cancelled if the status of your relationship is not truthfully informed to the department. 

    What can you do if your employer is not willing to sponsor you?

    You can check your eligibility for permanent residency through the General Skilled Migration pathway. 

    Am I still eligible for Subclass 187 if I have been stood down during the COVID-19 period?

    If you have been temporarily stood down, been on unpaid leave or had your hours reduced due to the impact of COVID-19 and related restrictions, these periods of time can still be counted towards the time worked for your employer. Your employer must provide evidence that you have been temporarily stood down, been on unpaid leave or had your hours reduced due to COVID-19 but your employment was not terminated.
