The Business and Investor Immigration pathway is designed for entrepreneurs or professional investors who want to own and run a business in Australia and eventually obtain permanent residency. 

Subclass 188 has multiple streams, which includes the:

Types of Business and Investor
Visa Application

Business Innovation Stream

This temporary work visa allows you to operate a new or existing Australian company.

Investor Stream

This temporary visa requires you to invest at least AUD2.5 million in Australia with an approved nomination by a State or Territory government.

Significant Investor Stream

This provisional visa is for people who invest at least AUD5 million in Australian investments that meet certain requirements and maintain investment activity in Australia.

Entrepreneur Stream

For startup and early stage entrepreneurs who have been endorsed to develop their concepts and been nominated by a State or Territory government agency.

Temporary Visa Eligibility

To be eligible for a Business Innovation visa, you must be:

  • Be under 55 years old.
  • Have functional English.
  • Be nominated by an Australian State or Territory government. 
  • Score at least 65 points on the points test.
  • Must have a successful business career
  • Not have a history of involvement in unacceptable activities.
  • For 2 out of 4 years before applying, you must have had an ownership stake in a business that had at least AUD 750,000 turnover for two years 
  • You must own (in 1 or 2 businesses) at least:
    • 51% of the total value of the business if the business has less than AUD400,000 turnover per year
    • 30% of the total value of the business if the business has AUD400,000 or more turnover  per year
  • You and/or your partner combined must have total net business and personal assets of at least 1.25 million. 

To be eligible for an Investor Stream visa, you must be:

  • Be under 55 years old.
  • Have functional English.
  • Be nominated by an Australian State or Territory government.
  • Intend to live in a specific State or Territory
  • Score at least 65 points on the points test.
  • Not have a history of involvement in unacceptable activities.
  • Must have had:
    • have at least three years of experience managing qualifying businesses or eligible investments,
    • have a successful record and demonstrated a high level of management skill of suitable investment/qualifying business activity
  • You and/or your partner must have total net business and personal assets of at least 5 million. 
  • For at least 1 of the five fiscal years before applying, you must have directly managed one of the following:
    • a qualifying business in which you, your partner or you and your partner combined had at least 10% ownership interest, or
    • An eligible investment of at least AUD 2.5 million is owned by you and/or your partner.

If you were invited to apply, you must make a complying significant investment of at least AUD2.5 million and continue holding it for the life of your provisional visa. 

To be eligible for a Significant Investor visa, you must be:

  • Be under 55 years old.
  • Have functional English.
  • Be nominated by an Australian State or Territory government agency
  • Not have a history of involvement in unacceptable activities
  • If you were invited to apply on or after 1 July 2021, you must make (on or after the time of application for this visa), a complying significant investment of at least AUD5 million when we invite you to and have a genuine intention to hold that investment for the life of your provisional visa.

To be eligible for a Entrepreneur Stream visa, you must be:

  • Be under 55 years old.
  • Have competent English.
  • Be nominated by an Australian State or Territory government agency
  • Receive an Invitation to apply for visa.
  • You must be undertaking, or proposing to undertake, a complying entrepreneur activity in Australia. You must have a genuine intention to continue this activity.
  • If you were invited to apply for this visa on or after 1 July 2021, you must be endorsed by your nominating State or Territory government agency to develop your entrepreneurial concepts.

Steps to Apply for Provisional 188 Visa

We will assess your Eligibility

To begin processing your Subclass 188 application, our Registered Migration Agents will evaluate your resume and confirm that you are eligible to apply for the visa.

During this discussion, we will identify your desired state, understand whether you would like to operate a business or manage an investment, and advise you of the suitable visa type within the stream.  

We will apply for State or Territory Nomination.

We will then assist you in lodging an Expression of Interest with your desired state if you meet the eligibility criteria. If not, we will recommend another condition for which you may be suitable and proceed accordingly. Please note that each state and territory has standards, so we will work with you to meet these criteria. 

We will apply for your Provisional Visa

Once you secure a nomination, we will assist you in preparing your application and documents for your desired visa stream in Subclass 188.

    No, you do not have to buy a business in advance, or invest any money anywhere before applying for a business visa.

    I am over 55 years of age. Can i still apply?

    If you are older than 55, a State or Territory might invite you to apply for this visa if your business will be of exceptional economic benefit.

    Do I need a travel ban exemption if I have been granted a business visa?

    No, you are not required to apply for a travel ban exemption if you have an approved business visa to travel to Australia.

    Can I apply for permanent residency?

    Holders of the Subclass 188 Business and Investment visa can continue living in Australia permanently by applying for a subclass 888 visa. Subclass 888 has multiple streams, which includes:
