Australian Partner Visas

Australian Partner Visa enables partners of an Australian citizen, permanent resident or eligible New Zealand citizen to permanently live in Australia. With this visa, you can:

  1. Work and Study in Australia without any restrictions.
  2. Access to Medicare from the time of lodgement
  3. Travel in and out of Australia as many times as you want

Types of Partner Visas include:

The Subclass 820/801 visa application is an onshore two-stage partner visa that enables a spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen residing offshore to move to Australia permanently.

Applicants must be onshore when they apply for the visa.

The Subclass 309/100 visa application is an offshore two-stage partner visa that enables a spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen residing offshore to move to Australia permanently.

Applicants must be offshore when they apply for the visa.

From 25 November 2023, the Partner (subclass 309) visa can be granted to applicants in or outside Australia. 

The Prospective Marriage visa allows you to travel to Australia to marry your prospective spouse and apply for a Partner visa. 

This visa is suitable for individuals that are in a relationship with a person from overseas, but do not have enough evidence to lodge a Partner visa application.

Applicants must be outside of Australia when you apply for this visa.

If you:

  • made an application for one of the below visas before 26 November 2023, and
  • you were in Australia at any time during the COVID-19 concession period

you can be granted a visa in Australia if you meet all other visa criteria.

Financial aspect of relationship

Under this section, you can provide facts and evidence of your financial commitment to each other.

Nature of household

In this section, you can provide evidence of any joint responsibility for the care and support of children, your living arrangements and sharing of the responsibility for housework. 

Social aspect of relationship

In this section, you can outline important social aspects of your relationship, including opinion of your family, friends and acquaintances about the nature of your relationship.

Nature of commitment

In this section, you can outline significant events in your lives during which you have relied on each other for support and future plans together.

Sponsor Eligibility

  • be an Australian citizen, permanent resident or eligible New Zealand citizen
  • meet the Department character requirements
  • be 18 years of age or older 
  • not have sponsorship limitations apply to you.

 

Applicant Eligibility

To be eligible for the visa, you must be: 

  • Aged 18 years or older
  • Intend to marry your intended partner who is an Australian citizen or permanent resident, or an eligible New Zealand citizen within 9 months of visa grant.
  • Must have physically met your partner in person, after turning 18.
  • Meet the health and character criteria.

Sponsor Eligibility

  • be an Australian citizen, permanent resident or eligible New Zealand citizen
  • meet the Department character requirements
  • be 18 years of age or older 
  • not have sponsorship limitations apply to you.

To be eligible for the visa, you must be:

  • Be in a genuine and continuing relationship with the sponsoring partner who is an Australian citizen or permanent resident, or an eligible New Zealand citizen 
  • Meet the health and character criteria.
